General Terms and Conditions

 

1.Scope of Application
These General Terms and Conditions (GTC) apply to all bookings and services related to tandem paragliding provided by Alivo Flying - Ivo Gamper. By booking a tandem flight, the customer/passenger (or, in the case of minors, the parent or legal guardian) accepts these GTC.

 

2. Reservations and Contract Conclusion
Reservations/bookings can be made via email, WhatsApp/SMS, or by phone. A contract is concluded once we confirm the booking. After the booking is made, both the pilot and the customer/passenger (or, in the case of minors, the parent or legal guardian) are obligated to appear at the agreed meeting point at the agreed time. All prices are inclusive of statutory value-added tax.

 

3. Agreed Start Time and Flight Duration
The agreed start time and the specified flight duration depend on several factors, such as weather conditions, the takeoff weight, the physical condition of the customer/passenger during the flight, and other safety-related aspects. Therefore, deviations from the times stated on flyers, the website, in emails, or messages may occur. The pilot reserves the right to adjust these factors to ensure the safety of the flight.

 

4. Health Requirements, Weight, and Fitness for Flight
The customer/passenger (or, in the case of minors, the parent or legal guardian) is required to provide accurate information regarding the weight, age, and health condition of the customer/passenger at the time of booking. This information is necessary to ensure optimal flight preparation, including selecting the appropriate equipment and determining the flight plan. Additionally, it allows the pilot to assess in advance whether the flight is generally feasible. However, the pilot reserves the right to refuse the flight if, based on a personal assessment and conversation with the customer/passenger, it is determined that the health or physical requirements are not met.

 

5. Flight Date and Weather Conditions
Flight dates are set by agreement. Due to weather conditions necessary for the safety of the flight, last-minute changes or cancellations may occur. In such cases, an alternative date or flight area will be offered. If the customer/passenger is unable to attend the new date, the flight can be rescheduled for a later time.
In the event of a weather-related change of date or cancellation of the flight due to force majeure, there is no entitlement to compensation, refund, or reimbursement of any other incurred expenses. However, the right to reschedule the flight remains in place.

6. Briefing and Instructions
Before the tandem flight, the customer/passenger will receive a detailed briefing from the pilot, including instructions on safety precautions and behavior during takeoff, the flight, and landing. The customer/passenger is required to strictly follow the pilot's instructions. Failure to comply with these instructions may endanger safety and result in the cancellation of the flight.

 

7. Decision on the Execution of the Flight
The pilot decides whether the flight will take place, based on the physical condition of the customer/passenger as well as current weather conditions. The safety of the flight is always the top priority. If the pilot cancels or postpones the flight due to unfavorable conditions or concerns about the health of the customer/passenger, an alternative date will be offered.

 

8. Signature of Form Before the Flight
The customer/passenger is required to sign the form provided before the flight. This form confirms that the customer/passenger understands the risks of tandem paragliding, that the health information provided is accurate and complete, that they have understood and will follow the pilot's instructions during the flight, and that they have read and agree to these terms and conditions. Without the signed declaration, the flight cannot take place.

9. Minors
Minors may only fly with the explicit permission of a parent or legal guardian. This permission must be given in writing. By allowing the minor customer/passenger to participate in the tandem paragliding flight, the parent or legal guardian agrees to the flight. Additionally, the parent or legal guardian confirms that the minor customer/passenger has been informed of all points listed in the form provided by the pilot, particularly points a), d), and i), and that these points have been understood. The parent or legal guardian agrees to be present before the flight and at the landing, and to sign the form before the flight.

10. Early Landing Due to the Customer/Passenger's Condition
If the pilot is forced to terminate the flight early due to the customer/passenger's health condition or if the customer/passenger feels unwell during the flight, the booked flight will still be fully charged. In this case, a refund is excluded.

11. Equipment
The necessary equipment for the tandem flight will be provided by the organizer and is already included in the agreed flight price.
The passenger/customer is required to wear suitable clothing for the tandem flight, particularly sturdy shoes (reaching above the ankles). In the case of a minor passenger, it is the responsibility of the parent or legal guardian to ensure that the passenger wears appropriate clothing.

12. Vouchers
Vouchers can be purchased for tandem flights and offer a flexible way to enjoy the flying experience at a later time or to give someone a gift. Paid vouchers are non-refundable. There is no set expiration date. However, if the flight price has changed after one year, the customer/passenger is required to pay the price difference when the voucher is redeemed.

 

13. Liability
The tandem pilot takes full responsibility for the execution of the flight. The customer/passenger acknowledges that they are aware of the risks associated with a tandem paragliding flight and accept these risks. The customer/passenger is liable for any damages caused by their own misconduct or failure to follow the pilot's instructions. The customer/passenger is also liable for damages to third parties caused by negligent behavior. The pilot is not liable for any lost or damaged items belonging to the customer/passenger before, during, or after the tandem flight. It is recommended not to bring valuable items during the flight or to securely store them before the flight.

14. Insurance
The tandem flights are covered by liability insurance. However, we recommend taking out personal accident insurance. The provider's insurance does not cover damages caused by the behavior of the customer or third parties.

 

15. Behavior During the Flight
The customer/passenger agrees to follow the pilot's instructions during the flight. Any behavior that endangers the safety of the flight may result in the immediate termination of the flight or the pilot's decision to not conduct the flight at all – without entitlement to a refund of the flight price.

16. Data Protection
The passenger/customer agrees that their personal data (including that of the minor passenger), such as first and last name, address, gender, tax number, ID number, phone number, and email, will be processed in accordance with Legislative Decree No. 196/2003 and the GDPR (EU) 2016/679 to fulfill legal requirements. Furthermore, the passenger/customer consents to the possibility of these data being shared with third parties within the EU to handle necessary processes such as insurance, police, or legal matters. Data will not be shared outside the EU.
Additionally, the passenger/customer agrees that during the flight, photos and videos may be taken for commercial purposes in which the passenger may appear. These images and recordings may be published and stored free of charge and without time limitations in media such as websites, television, newspapers, social media, and other channels. Consent for the use of photos and videos can be withdrawn at any time, but such withdrawal will not affect the lawfulness of data processing carried out before the withdrawal.

17. Final Provisions
If individual provisions of these Terms and Conditions are found to be invalid, the remaining provisions will remain unaffected. Changes or additions to these Terms and Conditions are possible at any time. Italian law applies. The court responsible for all legal disputes arising from the contractual relationship, including its formation and validity, for both parties, is the court with jurisdiction over the location of the provider, namely the District Court in I-39100 Bolzano.
